These Terms and Conditions (“Terms”) govern your use of the Kizombatouch website and the services, memberships, classes, events, and other products made available by Kizombatouch.
By accessing or using our website, creating an account, purchasing a membership, booking a class, purchasing an event ticket, or otherwise using our services, you agree to these Terms.
These Terms, together with our Privacy Policy and any additional terms applicable to specific services or products, constitute the agreement between you and Kizombatouch.
CHANGES TO TERMS
Kizombatouch may modify these Terms from time to time. Updated Terms may be published on the Website or communicated through other appropriate means.
You are responsible for reviewing the Terms periodically. Continued use of the Website or our services following publication of updated Terms constitutes acceptance of those changes.
Kizombatouch may also modify, update, suspend, or discontinue Website features, products, or services when reasonably necessary.
KIZOMBATOUCH ACCOUNT, REGISTRATION AND ACCESS
Age Restrictions
You must be at least 18 years old to create an account and use services requiring registration. By creating an account or purchasing our services, you confirm that you meet this requirement.
Account and Account Security
Certain services, including memberships and class bookings, may require you to create and maintain a personal account.
You are responsible for maintaining the confidentiality of your username and password and for activity conducted through your account.
You must notify Kizombatouch promptly if you become aware of unauthorized access to your account.
You may not use another person's account without authorization.
Kizombatouch is not responsible for losses resulting from unauthorized account access where such access was not caused by Kizombatouch.
SUBSCRIPTIONS, BILLING AND CANCELLATION
Automatic Renewal
The Basic Membership and All Inclusive Membership are monthly subscription services and automatically renew each month on the calendar day corresponding to the original commencement date of the subscription, unless cancelled.
Client Responsibility for Cancellation
Students may cancel their subscription at any time.
Cancellation must be initiated and completed by the student through their personal account dashboard under “My Subscriptions.”
Charges Following Failure to Cancel
Kizombatouch is not responsible for automatic subscription charges resulting from a student's failure to cancel the subscription before its renewal date.
Attendance or Website activity is not considered evidence of an intention to cancel.
The subscription remains active and the registered payment method may continue to be charged until cancellation is formally completed.
No Retroactive Refunds
Monthly membership payments are non-refundable.
If a subscription is cancelled during an existing billing cycle, membership access remains available until the end of that billing period. No prorated refund, retroactive refund, or credit will be provided for unused membership time or for subscriptions that the student forgot to cancel.
MEMBERSHIPS, FEES AND PAYMENT TERMS
Kizombatouch may provide paid classes and membership services through subscription plans, packages, or pay-as-you-go arrangements.
The available membership options, prices, and included services are described on the Website.
A valid payment method may be required when purchasing a membership or other paid service.
Students are responsible for all applicable charges associated with their purchases.
Membership Plans and Subscriptions
By purchasing a membership plan, you agree to pay the applicable fees according to the billing cycle or payment structure specified for that membership.
Kizombatouch may occasionally provide promotional offers, free trials, or discounted memberships. Unless otherwise stated, the applicable regular subscription fee may become payable once the promotional or trial period ends.
Billing and Billing Cycle
Subscription fees are charged when the membership begins and subsequently according to the applicable recurring billing cycle until the subscription is cancelled.
Billing dates may change in certain circumstances, including problems with a payment method.
Non-subscription plans are charged according to the conditions specified for the relevant package or plan.
Changes in Membership Plans or Fees
Kizombatouch reserves the right to modify membership prices or the structure of membership plans.
Where appropriate, reasonable notice will be provided before material changes become effective, allowing members to decide whether to continue or cancel their membership.
Continued use of a membership following the effective date of a notified change constitutes acceptance of the new conditions.
CANCELLATION AND REFUNDS
Monthly subscriptions and automatic renewals may be cancelled through the student's account.
To avoid being charged for the following billing period, cancellation must be completed before the next renewal date.
Cancellation becomes effective at the end of the current paid billing period.
Payments already made for the current billing period are non-refundable and are not prorated.
Refunds are also unavailable for non-monthly membership plans. Students are responsible for scheduling and attending classes within the conditions applicable to their particular membership or package.
CLASS CANCELLATION & MEMBERSHIP PAUSE POLICY
Basic and All Inclusive Memberships – Student Cancellations
The following class cancellation policy applies specifically to students holding a Basic Membership or All Inclusive Membership.
Once a student books a class, that reservation is considered confirmed.
If the student subsequently cancels the booked class for any reason, the class will be considered used.
Cancelled classes are non-refundable and cannot be credited, transferred, rescheduled, or replaced with a make-up class.
The same policy applies when a student fails to attend a booked class without cancelling (“no-show”).
Cancelling a class does not automatically pause or extend the student's membership.
MEMBERSHIP PAUSE - HOLIDAYS AND PLANNED ABSENCES
Students holding a Basic or All Inclusive Membership may request a temporary membership pause in case of holidays, travel, or another planned absence.
A membership pause must be explicitly requested directly from Kizombatouch at least seven (7) days before the beginning of the planned absence.
Memberships are not paused automatically.
Requests submitted less than seven days before the planned absence cannot be applied retroactively to classes already booked, cancelled, missed, or membership time already elapsed.
Once a pause has been approved by Kizombatouch, the membership will be suspended for the agreed period and subsequently resumed. The corresponding membership period will therefore not be lost during the approved pause.
A membership pause and a class cancellation are two separate procedures. Cancelling an individual class does not constitute a request to pause the membership.
CLASSES CANCELLED BY KIZOMBATOUCH
If a scheduled class is cancelled by Kizombatouch or by the instructor, affected students will not lose the class or the corresponding membership time as a result of that cancellation.
Where appropriate, the affected membership will be paused or extended accordingly so that students retain the membership time affected by the cancellation.
A class cancelled by Kizombatouch or the instructor will not be treated as a class used by the student.
EVENTS – LISTINGS, TICKETS AND REFUNDS
Event Listings and Descriptions
Events advertised through the Website are organized and managed by Kizombatouch unless otherwise stated.
Event information, including venue, date, time, and lineup, reflects the information available at the time of publication but may be subject to change.
Kizombatouch may cancel, reschedule, or modify events where necessary and will make reasonable efforts to correct significant inaccuracies brought to its attention.
Ticketing and Sales
Event tickets are generally non-transferable unless otherwise expressly authorized.
The ticket holder's name and/or email address may be required for admission verification.
Ticket sales are final except where otherwise provided in these Terms, including cancellation of an event or certain material changes.
Purchasers are responsible for providing a valid email address and for ensuring they can access their ticket.
Event prices may vary due to promotional offers or other pricing arrangements.
By purchasing a ticket, you agree to comply with event-specific requirements communicated by Kizombatouch.
Event Refunds
If an event is cancelled, eligible ticket holders may be offered a refund to the original payment method or an appropriate transfer to another event.
Where material event details are changed, Kizombatouch may provide appropriate alternatives, which may include attending the modified event, transferring the ticket, or receiving an applicable refund.
Except in the circumstances expressly provided by Kizombatouch, event tickets are non-refundable.
INTELLECTUAL PROPERTY RIGHTS
The Website and the content made available through it, including text, images, graphics, logos, videos, audio, software, and other materials belonging to Kizombatouch, are protected by applicable intellectual property laws.
Subject to compliance with these Terms, users receive a limited, non-exclusive, non-transferable and revocable right to access the Website and use Kizombatouch services for their intended purpose.
Unless expressly authorized, users may not reproduce, distribute, sell, modify, reverse engineer, scrape, commercially exploit, or otherwise misuse Website content or technology.
Third-party trademarks and intellectual property remain the property of their respective owners.
PROHIBITED USES AND ACTIVITIES
You may not use the Website or Kizombatouch services for unlawful, fraudulent, harmful, abusive, infringing, or disruptive purposes.

Kizombatouch may suspend or terminate access where a user materially violates these Terms.
USER CONTENT, FEEDBACK AND SUBMISSIONS
Where Kizombatouch allows users to submit reviews, comments, photographs, or other materials (“User Content”), the user confirms that they have the necessary rights to submit such material.
By submitting User Content, you grant Kizombatouch the rights reasonably necessary to use, reproduce, publish, adapt, display, and distribute that content in connection with its business and services, subject to applicable privacy and data-protection laws.
Kizombatouch may moderate, refuse, edit, or remove User Content where appropriate.
Suggestions, comments, ideas, or other feedback voluntarily provided to Kizombatouch may be used to improve or develop our services.

CLASS PARTICIPATION AND INJURY DISCLAIMER
Dance classes and related physical activities involve inherent risks of injury associated with movement and physical exertion.
By participating in a Kizombatouch class or activity, you acknowledge and voluntarily accept these inherent risks.
You are responsible for determining whether you are physically and medically able to participate safely. Where appropriate, you should consult a qualified medical professional before participating.
Students should inform their instructor of relevant injuries, physical limitations, or medical concerns that could affect their participation.
Kizombatouch and its instructors cannot guarantee that every individual requirement can be accommodated.
If you experience pain or injury during a class, you should immediately stop participating and inform the instructor.
To the extent permitted by applicable law, Kizombatouch and its instructors are not responsible for injuries, illnesses, property loss, or other damages resulting from risks inherent in participation in dance classes and related activities.
THIRD-PARTY LINKS, WEBSITES AND RESOURCES
The Website may contain links to websites or services operated by third parties.
Kizombatouch does not control those third-party services and is not responsible for their content, availability, security, privacy practices, or terms.
Accessing third-party websites or resources is at the user's own discretion and may be subject to separate terms and privacy policies.

Kizombatouch may collect and process personal information in connection with your use of the Website and services.

GOVERNING LAW
These Terms and disputes arising from or relating to the Website or Kizombatouch services shall be governed by the laws of Switzerland.
Subject to mandatory provisions of applicable law, disputes shall be submitted to the competent courts of Switzerland.
GENERAL TERMS
Waiver
Failure by either party to enforce a provision of these Terms on one occasion does not constitute a continuing waiver of that provision.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Assignment
Users may not assign their rights or obligations under these Terms without prior authorization from Kizombatouch where such authorization is required.
Force Majeure
Kizombatouch shall not be responsible for delays or failures caused by circumstances reasonably beyond its control, including natural disasters, pandemics, war, terrorism, major infrastructure failures, or comparable events.
Where reasonably possible, Kizombatouch will take appropriate steps to mitigate the effects of such circumstances.
Entire Agreement
These Terms, together with the Privacy Policy and any additional applicable terms or agreements, constitute the agreement governing your use of the Website and Kizombatouch services.
